A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Despite the fact that the Defendant was not a handler of narcotics, etc., the Defendant treated the Compannobricide (hereinafter referred to as “cubol”) containing the psychotropic drug ingredients, as follows:

On July 29, 2019, the Defendant: (a) received 32,000 won from the customers in the same place as the above-mentioned 1-A; (b) sold in a manner that cherbol water (25ml); (c) sold cherbol water (25ml); and (d1,000 won from the customers in the same place on August 2, 2019; (d) transferred 41,00 won from the customers in the same place; and (e) sold cherbine-ICN type 12-type 12-type 2; (b) cherbol-type 25-type 2; and (c) cherbol-type 10-type 10-type cherbol to the place designated by the customers.

C. Around September 3, 2019, the Defendant possessed 120 bitbols (per 10 boxes) by putting them on the front half for sale at the same place as the above 1-A at the same time as the above 1-A.

2. No person other than a pharmacist or herb pharmacist who violates the Pharmaceutical Affairs Act shall establish a pharmacy, and he shall sell drugs or acquire drugs for the purpose of selling them.

Defendant is not a pharmacist or herb pharmacist.
