A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. From August 22, 2011, the opening date of the business, the Defendant, as a director of Ansan-si Co., Ltd., Ltd., a victim in Ansan-si Co., Ltd., a member C from August 17, 2012, has overall control over the business and fund management of the said company.
On January 25, 2012, the Defendant: (a) deposited 13,000,000 won in the account of another corporate bank (G) in the name of the victim in the name of another corporate bank (G) at the office of the said victim; (b) deposited 18,03,744 won in the account of the victim’s customer E; and (c) remitted 7,000,000 won among them to the account of another corporate bank (G) in the name of the victim; and (d) voluntarily deposited 6,950,000 won in the account of the Defendant’s name and embezzled it.
In addition, from around that time to August 2012, the Defendant embezzled 67,450,000 won in total over eight times as shown in the annexed crime list.
2. The Defendant was asked by the victim I to receive and deliver the money that the victim had not been reimbursed from the gold-gu Co., Ltd. to the account in the name of the said Co., Ltd.
On February 1, 2012, the defendant received 4,050,000 won from the gold-gu Corporation, the debtor of the victim, from the Bank Account (F) of D Co., Ltd. and kept for the victim at the office of D Co., Ltd. around February 1, 2012.
6. On the same day, after transferring it to the Agricultural Cooperative (J) account in the name of another corporate bank account in the name of D Co., Ltd., the KRW 3,000,000 among them was voluntarily withdrawn from the Agricultural Cooperative in the name of D Co., Ltd., Inc., and consumed it for personal purposes. The remaining KRW 1,050,000 around that time embezzled the said KRW 4,050,000 by using public charges at will.
B. On July 5, 2012, the Defendant received 5,720,000 won from the gold-gu Corporation, the debtor of the victim, from the above corporation office, to the above corporation bank account (F), and on behalf of the victim.
