All appeals by the defendant and the prosecutor are dismissed.
Reasons
1. Summary of grounds for appeal;
A. Defendant 1 was guilty of the facts charged regarding the crime committed before April 2015, even though the Defendant, prior to April 2015, was believed to have worked as the vice president of G Co., Ltd. with the belief that the instant business would normally take place in a normal condition, and did not directly attract investors or have participated in the fund management. The lower court erred by misapprehending the facts and adversely affecting the conclusion of the judgment.
2) The punishment sentenced by the lower court (three years of imprisonment) is too unreasonable.
B. The above sentence declared by the prosecutor by the court below is too unhued and unreasonable.
2. Determination
A. The lower court rejected the Defendant’s assertion on the Defendant’s assertion of mistake of facts at the lower court, claiming the same as the grounds for appeal in this case, and based on the title “Determination on the Defendant’s and his defense counsel’s assertion” in the judgment, the lower court rejected the Defendant’s assertion in detail. The lower court, based on the circumstances acknowledged by the evidence duly admitted and investigated by the lower court, i.e., the circumstances acknowledged by the foregoing evidence, i., U.e., the amount of KRW 20 million on January 28, 2015, and KRW 32 million on January 29, 2015, invested in the instant project, and BD investment KRW 12 million on December 22, 2014 at the investigative agency, stating that the Defendant was named as the Vice-Chairperson of the Seoul Gangnam-gu DN2 (hereinafter referred to as “G”) and explained the Defendant’s explanation of the business structure, profits distribution method, principal, and profits distribution method, and secured the Defendant’s outlook for the K Group’s development project.
