A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On September 17, 2013, the Defendant was sentenced to a suspended sentence of ten months for fraud at the Seoul Central District Court, and the judgment became final and conclusive on November 29, 2013.

"2013 Highest 3100" Defendant made a false representation as if there is a person who sells D and net money or US dollars at a price lower than the market price, and conspired to acquire the purchase fund, such as net money, from the victim who believed it.

At around 11:30 on June 7, 2013, D, upon the above public offering, may bring KRW 200 million in cash from the victim G, H, I, etc. to the victim G, H, and I, etc. in the vicinity of F next arms located in Seongdong-gu Seoul Metropolitan Government, for the purpose of contract deposit, at the face of KRW 12.5km, and the sale remains 500-10 million in profits of KRW 500 on the face of the sale.

However, the defendant and D did not have the intention or ability to purchase the net money as the net money 12.5kg was not actually in fact, and even if they received KRW 200 million from the victim, they did not have the intention or ability to purchase the net money to the victim by using it as the purchase of net money 12.5kg.

In collusion with D, the Defendant, by deceiving the victim as such, received KRW 200,000 from the victim as the down payment of KRW 12.5kg net money.

"2014 Highest 1885" was known that the Defendant: (a) had been well aware of it with Pyeongtaek D; (b) there was no gold 12.5km from early 2013 to D; and (c) there was no profit from selling it; and (d) around April 2013, the Defendant sent D a photograph of 1km to D, thereby seeking money for purchase of gold; and (b) around June 7, 2013, D provided money for purchase of gold 200 million won through H.

around 15:00 on November 5, 2013, the Defendant appeared at the Seoul Eastern District Court located in Asan-ro, Gwangjin-gu, Seoul, Seoul, as a witness of the fraud case against Defendant D No. 2013 High Court Order 2013 High Court Order 201Da2043, and gave testimony.

The defendant is under trial of the above case.
