Defendant shall be punished by a fine of KRW 4,000,000.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. From May 15, 2015 to 18:500 on the same day, the Defendant, without a car driver’s license, driven a CV-si car in the section of approximately 100 km from the front of the 38th National Asian Culture Center to the front road of the Mineyang-si in Gwangju-gu, Gwangju-gu, Gwangju-dong Culture Complex, without a car driver’s license.
2. On May 2015, the Defendant sent KRW 200,00 to D and 200,000 to D within the NAS car and D (n, 16 years of age; hereinafter the same shall apply) parked in the parking lot for the resignation-based 49, Nam-gu, Nam-gu, 2015. On June 26, 2015, the Defendant sent 250,000 to D and provided sexual intercourse within the said car parked in the parking lot for the 5/18 Memorial Cultural Center located in Seo-gu, Seo-gu, Gwangju, Seo-gu, 152. On June 26, 2015.
3. On June 6, 2015, the Defendant, without a driver’s license for a car driving on the early 16:57, driven a CN-si car from approximately 400 meters away from the two roads in the middle of Seo-gu, Seo-gu, Gwangju to the 5:18 Memorial Culture Center, located in the 152-ro, Seo-gu, Seo-gu, Gwangju to the 5:18 Memorial Culture Center.
Summary of Evidence
1. Any statement made by the defendant in compliance with this Act;
1. Statement made on D in conformity with the statement prepared by a senior judicial police officer (second time);
1. Application of Acts and subordinate statutes making relevant entry into the register of driver's licenses to the accused;
1. Article 21 (1) of the Act on the Punishment of Acts of Arranging Sexual Traffic, Etc., concerning facts constituting an offense, the relevant Article of the Act on the Punishment of Acts of Arranging Sexual Traffic and the Selection of Fines), and Articles 152 subparagraph 1 and 43 of the Road Traffic Act;
1. Of concurrent crimes, the former part of Article 37, Article 38(1)2, and Article 50 of the Criminal Act [one of the concurrent crimes resulting from the violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (Commercial Sex Acts) on June 26, 2015] shall be applicable.
