Reasons
Punishment of the crime
[Criminal record] On September 8, 2016, the Defendant was sentenced to 8 months of imprisonment for fraud and 2 years of suspended execution at the Incheon District Court, and the above judgment became final and conclusive on September 20, 2016.
[Criminal facts]
1. On May 3, 2016, around 17:33, the Defendant posted a false statement to the effect that he/she would sell a contact tag of “AE” to a country of the Internet NAV car page, and that he/she would send a ticket if he/she sent a cultural gift certificate equivalent to KRW 50,000,000.
However, since the defendant did not possess the contact pockets, even if he received the price for the contact pockets from the injured party, he did not have the intention or ability to reduce the contact pockets.
Nevertheless, the Defendant, by deceiving the victim as such, received one copy (Fin number: AG) of cultural merchandise coupon in the amount of KRW 50,000 at the market price as the price for the goods on the same day from the victim.
2. On September 29, 2016, the Defendant posted an article to the effect that “it sells panty tamp and tamp tamps” on the Internet tamp in Yeonsu-gu Incheon PC room, Yeonsu-gu, Incheon, and that “The Defendant changed KRW 20,000,000,000,000,000,000 won for cultural gift certificates to be sold at KRW 20,000,000,000.”
However, since the defendant did not own pan panty tamp and tamps, even if he received cultural merchandise coupons from the injured party, he did not have the intention or ability to deliver pan tamp to the injured party.
Nevertheless, the Defendant, by deceiving the victim, was issued two fin numbers (AI and AJ) of two fin numbers of cultural merchandise coupons worth KRW 20,000 at the market price on the same day from the victim.
3. On December 23, 2016, the Defendant: (a) online Nexson’s online online game (htp:/cyphers. Nexon.com) at the one-time room in Yeonsu-gu Incheon, Yeonsu-gu, Incheon; and (b) sells AK a game machine 1,000 games through dialogue functions in the game.
