1. Circumstances and basic facts of the disposition;

가. 상속형 즉시연금보험 계약 체결 및 보험료 납부 1) 원고들의 조부(祖父)인 E는 2011. 12. 15. 알리안츠생명보험 주식회사와 계약자피보험자보험수익자를 본인으로, 보험기간은 종신으로, 연금개시일을 2012. 1. 15.로 하는 상속형 즉시연금보험(이하 ‘이 사건 알리안츠 보험’이라 한다

)을 체결하고 보험료 13억 원을 즉시 납부하였다. 2) E는 2011. 12. 15. 미래에셋생명보험 주식회사와 계약자피보험자보험수익자를 본인으로, 보험기간은 종신으로, 연금개시일을 2012. 1. 15.로 하는 상속형 즉시연금보험(이하 ‘이 사건 제1 미래에셋 보험’이라 한다)을 체결하고 보험료 406,000,000원을 즉시 납부하였고, 원고들의 조모(祖母)인 F은 2011. 12. 15. 미래에셋생명보험 주식회사와 계약자피보험자보험수익자를 본인으로, 보험기간은 종신으로, 연금개시일을 2012. 1. 15.로 하는 상속형 즉시연금보험(이하 ‘이 사건 제2 미래에셋 보험’이라 하고, 이 사건 알리안츠 보험과 이 사건 제1, 2 각 미래에셋 보험을 통틀어 ‘이 사건 각 보험’이라 한다)을 체결하고 보험료 894,000,000원을 즉시 납부하였다.

B. On January 15, 2012, E changed the contractor and beneficiary of the instant Algerz insurance from January 15, 2012 to Plaintiff A, and the policyholder and beneficiary of the instant 1 future insurance from Plaintiff B, respectively, and F changed the contractor and beneficiary of the instant 2 future deposit insurance into Plaintiff B.

C. Each of the instant insurance contracts, the contractor and the beneficiary of which are changed, shall be subject to the payment that the insured E or F shall live on the relevant day of the insurance contract each year, and the Plaintiff A or B, the beneficiary, who is the beneficiary, shall be entitled to the interest calculated at the time of commencement of the pension pursuant to the publicly notified interest rate.
