The punishment of the accused shall be determined by a year of imprisonment.

Punishment of the crime
1. 상해 피고인은 2019. 6. 10. 23:00경 김제시 B에 있는 피해자 C(여, 41세) 운영의 ‘D’에서 피해자에게 “내가 서울에서 왔는데 이런 거지 같은 방에서 어떻게 마사지를 받아야 하냐, 이 거지 같은 년이, 씹할 년, 좃같은 년 중국년!”이라고 욕설을 하고 이에 대하여 피해자가 피고인에게 욕설을 하는 등 반항하자 손바닥으로 피해자의 머리 부위를 1회 때리고, 양손으로 피해자의 머리채를 잡아 바닥에 넘어뜨리고 발로 피해자의 머리 부위를 수회 때려 피해자에게 약 2주간의 치료가 필요한 열린 두개내 상처가 없는 진탕 등의 상해를 가하였다.
