1. The Plaintiff:
A. Defendant A, 11,303,253 won, and 5% per annum from June 2, 2012 to May 30, 2013;
Reasons
1. The following facts may be found either in dispute between the parties or in full view of Gap evidence 1 to 6, 12, Eul evidence 5 to 8 (including each number; hereinafter the same shall apply), the fact inquiry results with respect to the Seoul Central District Court and the whole purport of the pleadings:
We concluded a land trust contract with the Korea Land Trust Co., Ltd. (hereinafter referred to as the “Korea Land Trust”) to newly construct and sell a commercial building on the instant land, which was the owner of Jongno-gu Seoul Metropolitan Government 2,17.4 square meters, D large 17.2 square meters and E large 458.2 square meters (hereinafter referred to as the “instant land”), and the Korea Land Trust Co., Ltd. (hereinafter referred to as the “Korea Land Trust”) concluded a land trust contract with respect to the land of Jongno-gu Seoul Metropolitan Government on December 24, 1996, and on D and E on October 22, 197, the registration of ownership transfer in the name of Korea Land Trust was completed.
After that, on October 25, 2000, the registration of ownership transfer for the whole land of this case was completed due to the trust property attribution in the name of New Technology New Technology on October 26, 2000 on the following day.
B. Meanwhile, The New Zealand constructed a building with 7 underground and 15 floors above ground (a total of 683 households; hereinafter referred to as the "building in this case") in the name of F containing each partitioned building listed in paragraphs (2) and (3) of the attached Table Nos. 2 and (3) of the attached Table Nos. 2 (hereinafter referred to as the "Attachment Nos. 2 of the attached Table") on the ground of this case, and obtained approval for use on November 6, 200, and completed registration for preservation of ownership on November 16, 200, and completed registration of ownership under the name of Korea Land Trust on November 21, 200, under the name of Korea Land Trust.
C. The Korea Land Trust shall complete the registration of ownership transfer as above.
