③ A purchaser may be exempted from the obligation to pay a considerable amount of proceeds of sale acquired by accepting a debtor’s pecuniary obligation against the relevant creditor in lieu of payment with the consent of the relevant creditor. In such cases, the auction court immediately designates the date of distribution without separately setting a deadline for payment (Article 143(2) of the Civil Execution Act provides that where a creditor is a purchaser, the creditor may pay the remainder other than the amount to be distributed on the date of distribution. Although there is no such provision, in the event the purchaser takes over the obligation, the principal and interest on the claim up to the date of distribution can be fixed, even in the case of assumption of obligation, and the number of the amount of the obligation taken over is certain, the difference between the proceeds of sale and the amount of the obligation taken over on the date of distribution shall be paid on the date of distribution inasmuch as there is no difference between the payment of difference between the buyer’s payment and the amount of the obligation taken over, inasmuch as the payment of the price has been made.
