All appeals by the defendant and the prosecutor are dismissed.

1. The defendant asserts that, with respect to the punishment (4 million won in punishment, and 40 hours in completion of child abuse treatment programs) of the judgment of the court below as to the summary of the grounds for appeal, the defendant is too small, and the prosecutor is too unhued and thus unfair.

2. The judgment is based on the following circumstances: (a) the defendant recognized his mistake and speaks against the defendant; (b) the defendant deposited the prescribed amount for the victimized child; (c) the defendant started to work at the child-care center operated by his mother's mother's mother after graduating from the university; and (d) the defendant seems to have committed each of the crimes of this case in a situation where he was familiar with his duty because of his failure to work for the child-care center operated by his mother's mother; (c) the defendant has no criminal history; and (d) the defendant seems to have no physical abuse; (d) the defendant's crime of this case has influenced the mental health and emotional development of the victimized child; and (e) the parent who believed the defendant and left the victimized child to the child-care center of this case appears to have

In full view of all the above sentencing factors, considering the Defendant’s age, sex, career, family relation, economic situation, background and motive leading up to the commission of the crime, circumstances after the commission of the crime, and other factors pertaining to the sentencing indicated in the records and arguments on the change of circumstances, the judgment below’s punishment is deemed appropriate and the Defendant and prosecutor’s assertion are without merit.

3. In conclusion, the appeal by the defendant and the prosecutor is dismissed in accordance with Article 364(4) of the Criminal Procedure Act on the grounds that the appeal by the defendant and the prosecutor is without merit. It is so decided as per Disposition.
