1. Facts of recognition;

A. The Plaintiff is a person who engages in the interior work business with the trade name of “C”.

The Defendant is a person who operates the “F Real Estate”, which is the real estate brokerage office in Jinju-si D and shopping district E, and the Plaintiff became aware of the introduction of G, and the Plaintiff requested the Plaintiff to construct the interior of the said real estate brokerage office (hereinafter “instant office”).

나. 피고는 그 과정에서 2016. 10. 20. 에어컨 설치까지 포함된 가격으로 공사금액 견적서를 보내달라고 요청하였고, 그에 따라 원고는 피고에게 총 공사금액을 12,500,000원(공급가액)으로 하고, 세부 시공내역에 관하여 천정 및 벽체 가벽공사, 천정 및 벽체 도배, 바닥데코타일공사, 벽면 파티션, 입구 샷시공사, 강화도어, 철거 및 폐기물처리, 씽크대 및 수전, LET 조명 공사 부분의 공사금액 10,000,000원, 시스템 에어컨(삼성) 설치 공사금액 2,500,000원으로 책정한 공사견적서(을 1호증, 이하 ‘이 사건 견적서’라 한다)를 보냈다.

2. Determination

A. 1) First of all, the obligation to pay the construction cost of the instant construction project is to be paid with respect to the agreed construction cost, and the construction cost of the instant construction project is to be paid with KRW 10 million, and the amount of the nine construction cost, including the building cost of ceiling and bricks, and KRW 2.5 million, and thus, the total construction cost of the instant construction project is to be paid with KRW 12.5 million (the instant estimate, the supply price of which is the supply price), and the construction contract is concluded around that time.
