Punishment of the crime

From June 2014, the Defendant, “2015 Highest 1322,” had posted a false advertisement stating that “I will sell Handphones in gallonies,” by accessing the Internet gallon site without any intention or ability to sell it to others, while living together with C and D, which are the aftermaths in the gallonel located in Daegu Seo-gu, Daegu, by means of online goods transaction fraud. Since then, the defendant, C, and D will send handphones to the victim E who reported and contacted the above advertisement on the same day through text message to the victim E.

“A false statement,” which received 85,000 won from the injured party at around 14:37 on the same day, via the Agricultural Cooperative Account (Account Number:F) in the name of C at around 14:37.

As above, the Defendant, in collusion with C and D, received a total of KRW 1,582,50 from 11 victims, such as the content of the list of crimes in attached Table 1 from July 20, 2014 to October 27, 2014.

However, even though the Defendant did not possess three mobile phones in galloned so that he did not have the intent or ability to send the victim to the victim, the Defendant, as seen above, by deceiving the victim and transferred KRW 200,000 to one bank account (H) in the name of the Defendant around 13:14 on the same day from the victim.
