피고인은 2014. 1. 28. 13:07경 피해자 B이 자신의 처인 C에 대해 사기꾼이라고 삼미시장 상인들을 대상으로 피해자를 찾는다는 광고지를 돌린다는 사실을 알고, 피해자에게 핸드폰번호 D으로 전화를 하여 “ 너 이 새끼, 너 하여튼 밤길 조심해라잉, 나 애들 풀어놨어, 너 눈에 띄면 너 이 세끼 그 자리에서 너 앉은뱅이 만들어 버려, 이 쌍놈의 새끼야 알아” “ 이 개세끼, 사람을 겁대가리, 좆만한 놈의 새끼가 씨발놈의 새끼가, 다른사람에게 야 야들아 애들 좀 오라고 그래, 이 개세끼 오늘 아주 완전히 아주 내가 않은뱅이 만들어버리게 야 E 애들 오라고 그래 당장 이 봉고차 타라고 그래 전부, 이 개세끼, 너 기다려 개세끼야”라고 말하여 피해자의 생명ㆍ신체에 어떠한 위해를 가할 듯한 태도를 보여서 그를 협박한 것이다.
