The fact that the Plaintiff did not perform the subcontracted construction work and the construction cost that was not paid by the Defendant is KRW 41 million,00,000,000, and that the Defendant transferred to the Plaintiff the amount equivalent to KRW 41,000,000,000, out of the Defendant’s claim for the construction cost to the New Construction Co., Ltd. for the payment of the above construction cost, but the Plaintiff did not have any dispute between the parties, or that the Plaintiff did not receive the above transfer money from the New Construction Co., Ltd. according to the purport of the entire pleadings.
