1. Defendant B’s share 3/11, Defendant C, D, E, and F are on each share of 2/11 shares, G of the wife population G of 3349 square meters, which each is permitted to the Plaintiffs.
Reasons
In full view of the purport of the argument as a whole, H is an owner of 3349 square meters in response to the wife G in Suwon-si, and H is an owner of 3349 square meters in response to the entry of the evidence No. 1, which entered into a pre-sale agreement with I on January 30, 1984, and completed the registration of transfer claim claim with H on February 3, 1984 by Suwon District Court Port Office (2324), H died on October 30, 2002. The Plaintiffs were children of H, who were succeeded to the said land one-half share of each one-half share through an inheritance agreement division, and the heir died on December 17, 2018, and the fact that there was Defendant C, D, E, and F, who is the spouse of the Defendant B, his children.
In other words, the right to complete the pre-sale is a kind of right to make the other party express his/her intention of the completion of the pre-sale and to make the effect of the sale; that is, the right to complete the pre-sale and to conclude the pre-sale within a certain period if it has been agreed between the parties, and within 10 years from the time when the pre-sale was made, unless otherwise agreed by the parties; and the right to complete the pre-sale
(See Supreme Court Decision 200Da26425 delivered on January 10, 2003, etc.). Thus, since the above claim for ownership transfer, which was completed in the name I as to the above land, is invalid registration, the above claim for ownership transfer, which is completed in the name of I, shall be deemed null and void registration. Thus, barring any special circumstance, the Defendants, an heir of I, are obliged to implement the procedure for cancellation registration of the above provisional registration with respect to each inheritance share
The defendants asserted that H is not the owner of the above land, but there is no evidence to acknowledge this.
The above assertion by the Defendants is without merit.
The plaintiffs' claims shall be accepted with due reason, and it is so decided as per Disposition.
