A defendant shall be punished by imprisonment for not less than three months.

Criminal facts

1. On April 13, 2012, the Defendant: (a) visited the Internet portal site NAVER’s “Negora” car page at the PC room located in Siang-si, Siang-si; (b) concluded that the victim B visited the victim and sold the said goods at KRW 80,000,000 by visiting the victim.

However, since the defendant did not possess the above objects, he did not have the intention or ability to sell them to the victim.

The Defendant, as such, by deceiving the victim, received KRW 80,00 from a national bank account (Account Number: C) in the name of the Defendant for sales of goods.

The Defendant received, in the above manner, from June 21, 2012, a total amount of KRW 3,229,500 in the market price over 23 occasions as shown in the attached Table 1 of Crimes List 1.

2. On May 15, 2012, the Defendant: (a) accessed the Internet NAVVV Kacack, which is located in Singuang-dong, Sinsi-si, Sinsi-si, and (b) called, on the bulletin board, that “Prc 200 ccc c. c. c. c. c. c. c. c. c. c. c. c. 290,000, the Defendant called, “on the part of the victim, you will sell to 290,000 won.”

However, because the defendant did not have the above visibility, there was no intention or ability to send it even if he receives the price.

On the same day, the Defendant received 290,000 won from the said victim’s account to the agricultural bank account in the name of the Defendant, as described in the list of crimes from March 1, 2012 to June 12, 2012, and as described in the list 2, up to 42 times in the above manner: Provided, That the date set forth in the table 2 of the annexed list 2 in the annexed list 14 shall be amended to “ March 31, 2012”, and the date set forth in No. 37 in the table 2 in the annexed list 2 to “ May 15, 2012”, respectively.

The victims received a total of KRW 4,993,000 from the victims.

Accordingly, the defendant was provided property by deceiving the victims.
