A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Since the defendant is led to confession, it is necessary to make an additional statement on the same part as the relevant supporting evidence in the same way as “(see, e.g., the page of the evidence record).”

Based on evidence, the prosecutor's facts charged are modified to the extent that it does not adversely affect the defendant's right of defense and actually affect the contents of the facts charged, and it does not result in the change of the subject of trial by the court.

In relation to “electronic financial transactions” under which a financial company provides financial products and services through electronic devices and a user uses them in an automated manner without meeting or communicating with employees of the financial company, no person violating the Electronic Financial Transactions Act shall transfer “means of access” such as user numbers registered with the financial company used to give instructions for transactions or to ensure the authenticity and accuracy of users and transaction details, unless otherwise specifically provided for in any Act.

Nevertheless, around July 2019, the Defendant opened an account under the name in which the account “B” was used on the Internet from a person who was unaware of the name, to the effect that “the Defendant would establish a juristic person and open an account under the name of the juristic person and give KRW 5,00,000 per week to the person who was not in the name of the juristic person (see, e.g., Article 74 of the evidence record).” (See, e.g., Article 74 of the record).

On July 26, 2019, the Defendant established C on July 26, 2019 (see, e.g., evidence No. 56 of the record) and registered D Co., Ltd. (hereinafter “D”) with “E” (see, e.g., evidence No. 42). On August 9, 2019, the Defendant transferred the means of access to the passbook, physical card, and OTP equipment connected to the D account in the name of the said C in the vicinity of “Sacheoncheon-ro, Chuncheon-ro, Chuncheon-ro, 2260.
