A defendant shall be punished by imprisonment for three years.

Punishment of the crime

On July 16, 2015, the Defendant was sentenced to four months of imprisonment for fraud at the Daegu District Court, and the said judgment became final and conclusive on July 24, 2015.

On October 2014, the Defendant came to know of the victim while performing the interior works of “X beauty room” operated by the victim W of the victim W in Busan-si, Busan-si. From the end of November 2014, the Defendant attempted to deceive the victim by deceiving him/her from the victim by advertising that he/she came to know of the fact.

1. The Defendant related to the fraud of the borrowed money held a deposit of KRW 800 million with the borrowed name account in the name of a relative who is a university professor, and purchased land in order to newly build a studio in Simsan-si, Simsan-si, and had a studio building by lending the name of a studio in Simsan-si, Simsan-si, and the Defendant’s female student was an attorney-at-law who was the husband and the husband was the public prosecutor, followed the Defendant’s financial history and background, and then, on December 24, 2014, the Defendant borrowed this from the above “X Beauty-si” to the victim, and “if the Defendant was to recover the deposit from a relative passbook, the construction cost for the temology to be repaid.”

However, even if the defendant borrowed money from the injured party, he did not have any intention or ability to repay it in the time.

As above, the Defendant, as well as the Defendant, by deceiving the victim as above, received KRW 13 million from the victim to the agricultural bank account in the name of the victim in advance, from the victim, and received KRW 19,287,600 in total over 118 times from around that time to June 11, 2015.

2. 피해자 명의 현대카드 사용 관련 피고인은 2014. 12. 27. 위 `X 미용실 `에서 피해자에게 “ 건축 자재비를 카드로 결재하면 5~10 %를 깎아 주는 관계로, 신용카드가 필요한 데 신용이 불량하여 신용카드를 만들 수 없으니 신용카드를 만들어 주면 그 대금은 피고인이 납입하겠다” 고 말을 하였다.
