Reasons
Punishment of the crime
The defendant is the owner of Seo-gu Etel in Seoan-gu, Seoan-gu.
On April 10, 2015, the Defendant entered into a real estate lease agreement with the victim H and the above Etel 207 on the part of the “G Licensed Real Estate Agent Office” located in the Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-si, with “the leased Defendant, the lessee, or the lessee from May 28, 2015 to May 27, 2017, and KRW 55 million from May 27, 2017,” and the Defendant would return the deposit safely at the expiration of the lease term to the victim. Etels are seven and twenty (7) households of the lease term of the 29 generation, namely, the total deposit amount shall not exceed KRW 320 million, and the deposit amount may be refunded even if it exceeds the auction.”
However, in fact, the actual Etel's number of rent, total amount of rent deposit, total amount of rent deposit, and total amount of rent deposit stated in the lease contract was higher than that of the actual Etel's number of rent, and the defendant's financial status was not good, and even if the defendant entered into a real estate lease contract with the victim, the defendant did not have the intention or ability to return
Ultimately, the Defendant, by deceiving the victim as such, received a total of KRW 50 million from the victim on April 10, 2015 and KRW 55 million on May 28, 2015, under the name of the deposit for lease on a deposit basis.
In addition, the Defendant received a total of seven victims of total seven times from June 6, 2013 to May 28, 2015, a total of KRW 39 million under the name of deposit money for lease, as described in the attached list of crimes.
