1. Defendant B Co., Ltd.: (a) KRW 23,957,600 for the Plaintiff and the period from February 24, 2017 to September 22, 2017.
Reasons
1. The facts following the facts do not conflict between the parties, or can be acknowledged in full view of Gap evidence 6, Gap evidence 7, Gap evidence 8, Gap evidence 10, Gap evidence 11, Eul evidence 12, Eul evidence 5, and the whole purport of the arguments.
The relationship 1) The Plaintiff Company was established on October 17, 2014, and D was engaged in the manufacturing and selling business of vibration mortars with the trade name “E” and transferred its goodwill to the Plaintiff Company on December 10, 2014. (2) Prior to April 1, 2012, Defendant C was engaged in the business of manufacturing vibration machinery, etc. with the trade name “F” and Defendant B Co., Ltd (hereinafter “Defendant Company”) was working as a representative director or director of the Defendant Company without conducting any separate business after it registered its business on April 1, 2012.
B. D and the Plaintiff Company’s transactional relationship 1) D requested debt collection against the Defendant C and the Defendant Company on October 16, 2012. The supply of the outstanding amount of KRW 56,597,340 to the Seoul Credit Information Company was fully repaid the outstanding amount of principal and interest until May 7, 2013 while the last suspension was made on January 7, 2013. (2) D began to supply the outstanding amount of goods to the Defendant Company from August 30, 2013 to November 28, 2014, while there was no outstanding amount of money for the Defendant C and the Defendant Company, and the Plaintiff Company began to supply the goods to the Defendant Company from November 28, 2014 after its establishment.
The amount of the transaction period (including value-added tax) D supplied to the Defendant Company: (a) from August 30, 2013 to December 31, 2013; (b) KRW 9,614,00 on December 31, 2014 to December 1, 2014; (c) KRW 33,82,244 won in total; (d) KRW 31,648,644 on January 1, 2015 to December 31, 2015; and (d) KRW 33,882,244 won in total; and (e) KRW 30,81.30 on August 28, 2014 to KRW 30,00 issued by the Plaintiff Company to the Defendant Company; and (e) KRW 15,13,000 on December 31, 201 to KRW 15,15,201; and (e) KRW 13,615,101.6
