Defendant
A and Defendant B shall be punished by a fine of three million won, and Defendant C shall be punished by a fine of four million won.
Reasons
Punishment of the crime
No person shall introduce, arrange or induce patients to medical institutions or medical persons for profit, and instigate such act.
1. The Defendant was the head of the planning team in charge of attracting patients at the D hospital specialized in the treatment of mentally ill persons and alcohol addicts, etc., and was either introduced from G, the head of the first-aid center F branch office in Sungnam-si around February 28, 201, and deposited KRW 400,000 in return for the introduction of patients at the above D hospital located in Sungnam-si, the head of the first-aid center F branch office in the first-aid center, and deposited KRW 40,000 from January 15, 201 to November 7, 2011.
Accordingly, for profit, the defendant had the above G et al. introduce, arrange, and induce patients to the above D Hospital, or introduced and arranged them to H hospital.
2. Defendant B: (a) was introduced by the head of the foregoing D Hospital’s principal affairs division; and (b) around February 10, 201, by the J, the head of the relevant D Hospital, the head of the relevant I branch of the C Hospital, and deposited KRW 400,000 in return for the introduction to the said J; and (c) was deposited KRW 5 million from January 5, 201 to April 13, 2012 as shown in the attached Table (2) in return for the introduction to the patient.
Accordingly, the defendant had the above J et al. introduce, arrange, and induce patients to the above D Hospital, or introduced and arranged them to H hospital.
3. The Defendant was a medical corporation established for the purpose of establishing and operating a medical institution, and L, the executive director of the K convalescent Hospital, the Defendant, was introduced by N, the employee of H hospital, in the above K K K K K convalescent Hospital, on September 22, 2011 and deposited KRW 300,000,000 in return for the introduction of his/her nameless patient to the above N in the above K K convalescent Hospital.
