피고인은 2013. 10. 3. 08:50경 안양시 동안구 C에 있는 D파출소에서, 같은 날 피고인이 주점에서 소란을 피워 경찰관이 범칙금 납부 통고서를 발부하였다는 이유로 경찰관들을 향하여 “야, 이 씹새끼야! 업주한테 공짜로 술이나 얻어 처먹는 짭새 새끼들!”이라고 큰 소리로 말하고 욕설을 하면서 파출소 바닥과 민원대에 침을 뱉고, 이를 제지하는 경찰관을 향하여 침을 뱉는 등 약 20분 동안 소란을 피워, 술에 취한 채로 관공서에서 몹시 거친 말과 행동으로 주정하거나 시끄럽게 하였다.
