1. Basic facts

A. The Plaintiff is an insurer who entered into an automobile comprehensive insurance contract with respect to B-Vehicles (hereinafter “Plaintiffs”).

나. 원고 차량은 2017. 4. 14. 17:10경 인천 중구 서해대로 296에 위치한 신용보증기금 앞 사거리(이하 ‘이 사건 교차로’라 한다)에서 편도 5차선 도로의 3차로를 따라 서해사거리 쪽에서 인천항사거리 쪽으로 직진하던 중, 인천항사거리 쪽에서 옹진군청 쪽으로 좌회전하던 C 차량(이하 ‘이 사건 사고차량’이라 한다)의 우측 부분을 충격하였고, 이 사건 사고차량은 그 충격으로 튕겨 나가며 옹진군청 쪽에서 인천항 남문 쪽으로 진행하기 위해 신호 변경을 대기하고 있던 D 차량(이하 ‘이 사건 피해차량’이라 한다)의 앞부분을 충격하였다

Due to the instant accident, the Plaintiff and the instant vehicle were destroyed by the accident, and the driver and the passengers of the instant vehicle and the instant damaged vehicle suffered injury. D.

During the period from April 27, 2017 to January 4, 2018, the Plaintiff paid total of KRW 21,965,630 as follows: (a) the sum of the medical expenses and the agreed amount for the above injury; and (b) the repair expenses for the Plaintiff’s vehicle and the instant accident vehicle.

The amount covered E (the driver of the instant vehicle) KRW 450,000 F (the driver of the instant vehicle) KRW 5,152,280 G (the driver of the instant vehicle) KRW 450,000 (the driver of the instant vehicle) KRW 540,000 (the passenger of the instant vehicle) KRW 105,000 (the passenger of the instant vehicle) and KRW 427,350 (the passenger of the instant vehicle) for the repair cost of KRW 4,00,000 for the instant vehicle, KRW 21,965,630,00 for the Plaintiff’s vehicle repair cost of KRW 10,841,00 for the instant vehicle

E. The Defendant is a local government responsible for installing and managing a local highway where the instant intersection is located.
