피고인은 2018. 10. 21.경 위 대학교의 E 'F' 페이지에 불상자가 432번째 글로 게시한 "D학교 G 진행하시면서 작년 H 인권 탄압은 왜 반성 안한데요? 선택적 인권에 놀라고 갑니다 학교 수듄ㅋ"라는 글에 피해자가 "아 나 I 교수님 수업에 발제할거 정해졌다 ㅋㅋ 원래 북한 기아문제 하려고 했는데 남자 성범죄 무고 해야겠음 ㅋㅋㅋ 학교에 예가 있네"라는 댓글을 달자, 2018. 10. 22. 불상지에서 피고인이 그 댓글에 대하여 다시 댓글을 달면서 피해자와 말다툼하는 과정에서, 같은 날 02:26경 "반말은 왜해요. 개싸가지 ; 거 예의조ㅗㅁ 지킵시다", 02:29경 "꼰대시구나...죄송... 꼰대면 뭐 흥분해서 초면에도 반말할수 잇죠ㅋㅋ 이해해용~~", 02:31경 "아니 그냥 제 이름 불리는거 싫다 고요 ㅋㅋ 이해못함?? 글 제대로 못파악함?? 제가 여기서 C이 고추 작다고 하면 님 기분안나빠요? 전 제 친구 J 말한건데요. 기분나쁘시죠? 그러니까 저도 기분나쁘다고요", 02:39경 "C이 바퀴벌레네", 02:48경 "그니까 과만 알면되지 학번은 왜 묻냐구요 저도 그의미 학번으로 질문한건데?? 아...나이 알아내서 꼰대짓하려구... 죄송 꼰대면 그럴수 있죠... 학번 중요하죠", 03:10경 "그니까... 피씨충이네 혹시 더 나아가서 인권팔이 하실 생각은 없는지? 큼큼"이라는 댓글을 게시하여 공연히 피해자를 모욕하였다.

피고인은 2018. 10. 22. 불상지에서 제1항 기재 피해자 작성 댓글에 대하여 다시 댓글을 달면서 피해자와 말다툼하는 과정에서, 같은 날 02:46경 "내 탐라는 왜바 ㅋㅋㅋ하는 짓도 K같애 강 ㄹㅇ 모둔게 K랑 싸울 때랑 같아. 우에 존나 저 말투 ㄹㅇ 꼰대더러운 아재. 그냥 너 같은 루저 외톨이 상처뿐인 겁쟁이 못된 양아치랑 말 안섞을래, 그냥 태생부터 멍청이 인걸,, 너무 멍청해,,, 멍청,,,, 해, 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 더러워 C이 더러웡!! 아니 C 좆나 더러워"라는 댓글을 게시하여 공연히 피해자를 모욕하였다.
