A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. In order to establish a consumer life cooperative in violation of the cooperative law among consumers, at least one unit of investment shall be made, as stipulated by articles of association, and the number of units of investment by one member shall not exceed 20/100 of the total number of units of investment, and at least 300 persons who consent to the establishment of a cooperative shall be at least 30 and the total amount of investments by a person who consent to the establishment shall be at least 30 million won;

On April 4, 2013, the Defendant: (a) at the office of D located in Gwangju Northern-gu, Gwangju; (b) at the office of D, 5 million won investment from E, 5 million won investment; (c) at the office of D located in Gwangju Northern-gu, Gwangju; and (d) at the office of D, the Defendant drafted a false certificate of investment as if the Defendant invested 10,00 won investment from E, 5 million won investment.

On August 2, 2013, the Defendant submitted an application for D authorization to establish a partnership on August 28, 2013 by submitting an application for D authorization, along with a false investment payment certificate, at the private economic department office of the Gwangju Metropolitan City Office located in the Seo-gu Incheon Metropolitan City, Seo-gu.

On September 3, 2013, the Defendant entered the application for establishment registration in accordance with the letter of authorization to establish the Gwangju District Court’s office located in Gwangju Dong-gu, Gwangju, in a false manner, the amount of KRW 3,221 per total number of investments, KRW 32,220,00 on the application for establishment registration was falsely entered and made on the same day.

Accordingly, the defendant registered the establishment of D by false or fraudulent means.

2. No person, other than a medical corporation, such as a violation of the Medical Service Act, a medical doctor, medical corporation, or non-profit corporation, may establish a medical institution, and no medical institution established and operated by a person who is prohibited from establishing a medical institution under the name of a medical person, medical corporation, etc. may claim medical care benefits
