Punishment of the crime

around January 18, 2013, the Defendant stated that “Around January 18, 2013, the Defendant would make the victim E find employment by requesting the F director who works for EsM to work for EsM, so the Defendant would first change five million won from the street funds.”

However, the defendant did not know of the above F director and did not have the intent or ability to employ the victims as above, and even if he received money under the pretext of school expenses as above, he thought that it will be used as living expenses.

On January 19, 2013, the Defendant received five million won in total from the victim to the credit union account used by himself/herself as school expenses, and received and remitted KRW 14.2 million in total on five occasions from January 1, 2013 to February 7, 2013, as shown in the list of crimes, as shown in the list of crimes.

Accordingly, the defendant acquired property by deceiving the victim.

Around July 2009, the Defendant stated that “Around July 2015, the Defendant issued money to his natives, 10,000,000 won, and 10,000 won, to his natives, to the victim G, who was aware of the family in Ulsan-gu, Ulsan-gu, Seoul-gu, and that “Around July 2009, the Defendant would give employment to the H company by taking advantage of the regular business of the H company.”

However, even if the defendant is not aware of the regular business of H company, he did not have the intention or ability to find the victims' children in the above company, even if he received the money for employment from the victim.

Accordingly, the defendant deceivings the victim as above and acquired 10,000,000 won in cash immediately from the victim.
