A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2019 Highest 4124]

1. Larceny;

A. On August 19, 2019, around 23:00 and around 11:30 on August 20, 2019, the Defendant: (a) discovered the LG Smartphone case that was kept on the head of Geumcheon-gu Seoul Metropolitan Government, and then stolen one copy of the Defendant’s corporate card of the Defendant’s bank management, which was kept in the said LG smartphone case, using the gaps where the victim D was locked, and the surrounding surveillance was neglected.

B. On August 25, 2019, at around 20:50 to 21:05, the Defendant: (a) opened a soup roup gate, which was located in the Dong-gu Daejeon-gu Daejeon-gu, the Defendant: (b) laid down the key on the head of the victim G while locked; (c) took cash of KRW 64,00; (d) one credit card for the new bank; (e) one credit card for the corporate bank; and (e) three copies of the set-down roto room located in the Dong-gu Daejeon-gu, Daejeon-gu.

2. On August 25, 2019, the Defendant violated the Fraudulent and Specialized Credit Financial Business Act: (a) purchased laverb B, etc. within the IE located in Daejeon-gu Daejeon-dong, Daejeon-gu on August 25, 2019; and (b) the Defendant purchased laver

The new bank credit card in the name of G, as described in the list of crimes, presented 8,200 won to the convenience store's salesperson as if it were the credit card owned by the Defendant, and paid 8,200 won for the goods. From that time to August 26, 2019 to August 21, 2019, the sum of 435,400 won was settled over four occasions, as shown in the list of crimes in the attached Table, and the stolen credit card was illegally used.

3. Fraud by using computers, etc.;

A. On August 25, 2019, the Defendant purchased one bus passes equivalent to the market price of 4,400 won, using a ticket without boarding passes, within a Daejeon Complex, which is located in the Dong-dong, Daejeon, Daejeon, on August 25, 2019, at around 21:30, and at least 11,000, the Defendant purchased one bus passes in Seoul, which is equivalent to the market price of 4,400 won.

The new bank card in the name of the victim, such as the statement in the paragraph, is illegal as if it were the credit card owned by the defendant.
