Basic Facts

On September 28, 2012, the Plaintiff entered into a contract with C’s agent as a broker of the Defendant, a licensed real estate agent, to exchange 13,223 square meters out of C’s equity and G 331 square meters of forest land (hereinafter “instant exchange contract”) among 25,223 square meters of forest land owned by C and 25,223 square meters, which is located in the land E site and its ground (hereinafter “Plaintiff’s site and building”), and to exchange 13,223 square meters among 25,223 square meters of forest land owned by C (hereinafter “instant exchange contract”), and under the exchange terms, C entered into an agreement with C as to H, I, J, K, and 4 lots of land owned by C as co-ownership to transfer the ownership of 6.61 square meters in total to the Plaintiff.

On September 27, 2012, the day before the conclusion date of the instant exchange contract, the Defendant issued to the Plaintiff a written confirmation on the land use plan of the said F forest as shown in attached Table 3 and the land use plan of T-owned forest 9,187 square meters (hereinafter “the adjoining land owned by others”) to the Plaintiff.

(C) On October 2012, 2012, the Plaintiff, Plaintiff’s wife L, and D prepared a MOU (No. 21; hereinafter “instant MOU”) with the following content on October 30, 2012, each of the above documents was made available for perusal, and the date of inspection at the bottom of the document was written as “ September 27, 2012.” After which the Plaintiff, Plaintiff’s wife L, and D’s name was written, and their seal impression was affixed respectively, and the status of forests and fields, etc., which were written at the MOU of this case was written as “C” image.

A) On the other hand, the road section: 33.058 square meters among H farm site 89 square meters, 33.058 square meters among I forest land 812 square meters, 33.058 square meters among J forest land 467 square meters, and 33.058 square meters among K forest land 1,925 square meters (hereinafter “C-owned road”), and is combined with “forest and forest land owned” as above.
