A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 5, 2014, the Defendant: (a) driven the ENAS coo vehicle at a cafeteria parking lot located in C on April 21, 2014; (b) while under the influence of alcohol level of 0.164%, the Defendant driven the ENAS coo vehicle at a level of 5 meters.

2. On April 5, 2014, at around 21:35, the Defendant: (a) while driving the said NAS coo car at the said D cafeteria parking lot in the state of drinking, the Defendant: (b) received a report on the disturbance of the owner on the part of the said D cafeteria; and (c) received a request from G (50 years old) from the head of the Gu Police Station at the seat of the said G (hereinafter referred to as the “D cafeteria”); (d) failed to comply with the request; (b) attempted to stop the vehicle, breath, and submit a license; and (c) attempted to leave the site, “the police police who had driven the vehicle without the driver’s license; (d) attempted to breath; and (e) attempted to flaf the flab; and (e) assaulting the flab with the flab, and keing the flaf with the left side with the left side.

As a result, the Defendant interfered with the legitimate performance of duties by police officers concerning the handling of reported cases and the crackdown on drinking driving, and at the same time, the Defendant placed knee knee in the victim G in need of approximately two weeks of medical treatment.

3. 모욕 피고인은 2014. 4. 5. 21:45경 위 제2항의 행위로 인하여 공무집행방해 혐의로 현행범인 체포되어 상주경찰서 F지구대 내에서 조사를 받던 중, 위 지구대 소속 경찰관들, 피고인의 고용주인 H 부부 등이 있는 가운데, 피해자 G 경위를 향하여 “야, 씹할 놈들아, 내가 뭘 잘못했는데, 개 씹할 놈아, 씹할 놈, 개새끼, 죽는다!”라고 1시간 동안 큰 소리로 욕설을 하여 공연히 피해자를 모욕하였다.

4. On April 5, 2014, the Defendant: (a) destroyed and damaged property by putting a pedal, such as taking a bath, etc. within the F District Zone of the Standing Police Station at issue, such as taking a bath as prescribed in paragraph (3) of the said Article; and (b) broken down a yellow bamboo amounting to KRW 70,000 in the market price at which she had left hand.
