A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. [2014 Height 87] On January 23, 2014, the Defendant driven a C rocketing car under the influence of alcohol with approximately 50 meters alcohol concentration of 0.175% from the 50-meter section from the front day of the Gumi-si Corporation, Gumi-si to the front day of the Gumi-si Corporation.

2. [Attachment 2014 Highest 1179] On May 28, 2008, the Defendant was sentenced to imprisonment for four months and two years of suspension of execution due to a violation of the Road Traffic Act by the Daegu District Court on May 28, 2008. On February 12, 2014, the Defendant was not detained as a crime of violating the Road Traffic Act (driving) in the Daegu District Court Kimcheon-cheon Branch on February 12, 2014 and is currently pending trial.

On August 16, 2014, at around 03:30 on the 03:30th day from the roads on the insular road, the Defendant driven C rocketing car with approximately 170km alcohol concentration 0.120% under the influence of alcohol without obtaining a driver's license from the 170km-dong, Seo-gu, Seo-gu, Seo-gu, Daegu, to the front road.

Accordingly, the defendant, who violated two times the prohibition of driving under the influence of alcohol, was driving a motor vehicle without obtaining a driver's license under the influence of alcohol.

B. The Defendant violated the Guarantee of Automobile Accident Compensation Act, as a holder of Crocketing passenger vehicles, was prohibited from operating an automobile on the road which was not covered by mandatory insurance, but operated the said cargo vehicle that was not covered by mandatory insurance, as described in paragraph (1).
