The prosecution of this case is dismissed.

1. The Defendant is the representative director of Pyeongtaek-si Co., Ltd., located in Pyeongtaek-si B, who runs the distribution business using six full-time workers.

(a) When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;

Nevertheless, the Defendant did not pay the total amount of KRW 25,657,310 for three workers within 14 days from the date of retirement without an agreement between the parties, as shown in the list of crimes in the attached Table, including that the Defendant worked in the said workplace from January 4, 2016 to May 31, 2016 and did not pay KRW 838,389 of the amount of wages in March 2016.

(b) An employer who violates the guarantee of retirement benefits of an employee shall pay a retirement allowance within 14 days after the ground for such payment occurred, in cases where the employee retires;

Nevertheless, the Defendant worked in the aforementioned business from December 1, 2014 to April 30, 2016, and did not pay KRW 2,330,040 of the retirement allowances of E retired from office within 14 days from the date of retirement without an agreement between the parties.

2. Reasons for dismissing the prosecution - The defendant's non-compliance with punishment - the withdrawal of a petition by all workers stating that the defendant does not want the punishment has been submitted.
