The Defendant’s motion to attach the instant attachment order is dismissed.

1. Summary of the facts charged and the facts constituting a request for attachment order;

A. The summary of the facts charged and the person against whom the attachment order was requested (hereinafter “defendant”) are the father of the victim B (a person who is named, female, and 7 years old).

From April 2016 to May 2016, the Defendant: (a) placed the victim in the house of the Defendant of the C Apartment D, Namyang-si, Namyang-si; (b) placed the victim on three occasions; (c) putting the victim in side; (d) putting him in the clothes of the victim; and (c) putting him/her in a sound room with the victim’s clothes.

Accordingly, the defendant committed an indecent act against the victim who is under 13 years of age on several occasions.

B. The Defendant, the cause of the request for an attachment order, committed a sexual crime against a victim under the age of 19, and is likely to recommit a sexual crime in light of the background and method of the instant crime, character and conduct, etc.

2. Determination

A. 1) The determination of the facts charged is based on evidence consistent with the facts charged in this case, the victim's investigative agency and this court, CDs containing the victim's statements, each CDs containing the victim's statements, the victim's statements, the victim's statements, and the statements and statements in this court prepared by E, the defendant's wife, and the defendant's wife. The remainder of the evidence, excluding each of the above evidences, is not direct evidence of the facts charged in this case, but merely merely an auxiliary material for the victim and E's credibility of the victim and E's statements, or there is a value of evidence to prove credibility of the victim and E's statements. 2) In full view of the following circumstances acknowledged by the records in this case, each of the victim and E's statements that the victim committed an indecent act against the defendant as described in the facts charged in this case, it is difficult to recognize credibility of the statements.

Therefore, unless the credibility of the victim and E statements is recognized, the prosecutor submitted them.
