1. The Defendant shall pay to the Plaintiff KRW 361,384,424 and the interest rate of KRW 15% per annum from January 20, 2017 to the date of full payment.

1. Indication of claim;

A. A. Around March 2016, the Defendant received a contract for civil engineering works among the construction works for the construction works for the Geumsan Yaeul apartment in Yangsan-si, which was performed on the east-si, Yangsan-si. The Plaintiff leased the Defendant with a driver for the construction of the said construction works, such as sckes and dump trucks, and the Plaintiff was to receive a certain amount of usage fees according to the volume of work.

B. The Defendant paid only the user fees up to July 2016 out of the mid-term rental fees that the Plaintiff leased as above to the Plaintiff, and did not pay a total of KRW 361,384,424 from August 2016 to December 2016.

C. Therefore, the Defendant is obligated to pay the Plaintiff fees of KRW 361,384,424 and damages for delay calculated at the rate of 15% per annum from January 20, 2017 to the day of full payment, which is the day following the delivery date of a copy of the instant complaint.
