A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No person, other than an attorney-at-law, who has violated the Attorney-at-Law Act, shall handle or arrange legal affairs concerning litigation cases, non-contentious cases, general legal cases, etc. in return for money, valuables, entertainment or other benefits;
A. On December 22, 2008, the Defendant, not an attorney-at-law, received a request for legal affairs, such as the analysis of rights and tender marks, and received 2,00,000 won as fees, in relation to the auction case (Seoul District Court Young-gu Seoul District Court Young-gu 201, 201, D or E, and 200,000 won in terms of the fees.
B. On November 30, 2009, the Defendant, not an attorney-at-law, agreed to receive fees from 201, D, and H of the Daegu Jung-gu C building 201, D, and H, and agreed to handle the auction case (J of the Daegu Jung-gu District Court) of I apartment 1 and 702 on behalf of the Defendant at the request of legal affairs, such as the analysis of rights and the preparation of a bidding slip.
C. On January 5, 201, the Defendant, not an attorney-at-law, received 2,00,000 won from K for legal affairs, such as the analysis of rights to auction cases (Tgu District Court L), and the preparation of bid table, and received 2,00,000 won for fees.
As a result, the defendant was not a lawyer and dealt with legal affairs concerning others' legal cases.
2. When the Industrial Bank of Korea, the creditor, filed a request for auction against the Daegu Jung-gu I apartment 1 and 2501, and the auction has been conducted to Daegu District Court L, the defendant, as in paragraph 1(c) of the above above, will receive the request from K, the husband of the M, who is the owner of the above 2501, to obtain a successful bid for the above auction, and will process it instead, with D and D, the actual manager of the KO, who is the employee of D, filed a false lien report with the bidding participants.
