Reasons
Punishment of the crime
1. Defendant A is the representative director of Dogwon-gun D Co., Ltd. and is the person in charge of safety and health management of the above company, and Defendant B is a contracting company for tin Han-gun Co., Ltd. by separating the management of laundry within the same business place.
The owner of a business, part of which is carried on at the same place and which is given a contract separately, shall take measures to prevent industrial accidents, such as the installation of safety and health facilities, if his/her employees work at a place where there is a risk of industrial accidents, such as the collapse of earth and sand, fire, explosion, fall, or falling, etc.
Nevertheless, the Defendant did not take safety measures such as the following:
Where a business owner constructs a bridge-type passage, etc., he/she shall take solid measures by using hardware, etc. so that the columns of a sloping bridge may not be connected or cut at the time of use.
Nevertheless, on June 3, 2014, the Defendant did not take safety measures because of the failure to fix a sloping bridge used in the above company on the spot so that it does not cover or cover up.
