1. Basic facts

A. On July 2015, the Defendant entered into a business agreement with the Committee for Promotion of the Regional Housing Association (Chairperson C) and the Construction and Management of the Company, etc. of the District Housing Association (hereinafter “instant project”). The Defendant decided to take charge of the draft of the membership agreement, the sales affairs, etc.

B. On July 9, 2015, the Defendant entered into an apartment sale agency contract with the Plaintiff regarding the sales business among the instant projects (hereinafter “instant apartment sale agency contract”) and received KRW 50 million from the Plaintiff as the sales agency deposit (hereinafter “instant sales agency deposit”).
