Punishment of the crime

No person of "2014 High 1309" shall allow any codes, words, sound, image, or motion picture that arouses fear or apprehensions through an information and communications network to reach another person repeatedly.

그럼에도 불구하고 피고인은 2013. 12. 19. 21:53경 서울 용산구 B, 2호에 있는 피고인의 주거지에서 피고인의 휴대전화(번호 C)를 이용하여 피해자 D의 휴대전화(번호 E)에 “무고죄각오^^ 어제 KTX에서 F씨 꼴이 말도 아니었네 증여잘처리해라 절세하려고 쑈를 하네 짜고치는 고스톱 ㅋㅋ 미친년 니가 미친년이지 바람이나 피지 마라 G아파트에서 소문이 파다하네 F씨이 불쌍하네 너희들 한짓거리 생각하고 협박죄든 뭐든 고소하려다가 아니면 정말 파묻어 버릴까하다가 옛정 생각해서 참는다 하긴 세발의 피도 안되지 너닮아 못생긴 딸년은 제발 나대지 말라 해라 성형해도 그 모양이냐 진짜 웃긴다 아 참고로 당신네학교 찾아가 뒤엎어버리신단다 우리 어머니께서 경찰이 찾아갈거야 히히 거리던 니병신같은 딸년한테 전해 뒤지고 싶지 않으면 까불지 말라고 알겠니 ”라는 내용으로 공포심이나 불안감을 유발할 수 있는 문자메시지를 발송한 것을 비롯하여, 그 무렵부터 2013. 12. 20. 00:11경까지 18회에 걸쳐 별지 범죄일람표 기재와 같이 반복적으로 공포심이나 불안감을 유발하는 문자메시지를 도달하게 하였다.
