피고인은 2016. 9. 16. 21:50 경 김해시 B에 있는 'C 슈퍼' 앞에서, 그전에 위 슈퍼에서 물건을 구입하였다가 잠시 후 음료수를 구입하러 다시 찾아 가 문을 두드렸으나 문을 열어 주지 않은 것에 화가 나 큰 소리로 고함을 지르면서 난동을 부린 것에 시비된 후 신고를 받고 현장에 출동한 김해 중부 경찰서 D 파출소 소속 경위 E( 남, 50세), 순경 F( 남, 33세) 이 피고인에게 귀가를 하라고 하였으나 계속 소란을 부려 동 경찰관으로부터 음주 소란 스티커를 발부를 받은 것에 화가 나 동 경찰관들에게 " 씨 발 놈 아 좃 같은 자식들 아 날 죽여 라 잡아가 새끼들아 시발 놈들이 "라고 큰 소리로 말하여 마을 주민 5명이 있는 가운데 공연히 피해자들을 모욕하였다.
