A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
[criminal history] On October 11, 2017, the Defendant was sentenced to a suspended sentence of one year for four months by imprisonment with prison labor for larceny of a structure intrusion at night at the Ulsan District Court, and the judgment became final and conclusive on the 19th of the same month.
[Criminal facts]
1. Embezzlements of deserted articles in possession;
A. On May 2017, the Defendant: (a) 06:00 as of the end, the victim C, who was on his/her chaired in the Taecheon River Station located in Ulsan-gu, Ulsan-gu; (b) did not take necessary procedures, such as acquiring one LG smartphone equivalent to KRW 800,000, and returning it to the victim; and (c) did so.
B. On June 2017, the Defendant, at around 20:0, 2017, found the victim D, who was away from the floor of the room in the city bus terminal located in Ulsan-gu, Ulsan-gu, Busan-do, as of the end, to have his own idea without following necessary procedures, such as acquiring one Samsung Smartphone equivalent to KRW 1,00,000, and returning it to the victim.
Accordingly, the defendant embezzled each of the assets that have been separated from the possession of the victims.
2. Larceny;
A. On July 28, 2017, the Defendant: (a) around 01:30 on July 28, 201; and (b) around 1.
A. The bicycle parking zone, in front of the Taecheon River basin, parked by the victim E as a locking device, found a bicycle with a size of 400,000 won at the market price owned by the bicycle parking zone, and returned a locking device to the surrounding area and removed the locking device.
B. On August 24, 2017, at around 17:05, the Defendant parked in front of the bicycle parking zone in front of the Taecheon River basin with a correction device, and discovered 1,200,000,000 bicycles owned by the victim F, and cut off the correction device with a small nicker holding by another Defendant.
Accordingly, the defendant stolen the victims' property.
