A defendant shall be punished by imprisonment for not less than three years and six months.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

[Judgment of the court below] On October 2019, the Defendant: (a) opened a SNS Telegram Telegraphing Library; (b) opened a “D” room on December 2, 2019; (c) sent children and youth pornography and adult pornography to the above “D” room through another teleg users in the name of the said “D” room; and (d) advertised the sale of obscene materials to the “B” room and “C” room to receive entrance fees from those who wish to purchase obscene materials; and (d) received them by accessing the said “D” room and received them so that they can download the said obscene materials.

Nevertheless, around December 11, 2019, the Defendant posted a message to “C” bank, “C” using the Defendant’s cell phone device at the Defendant’s residence, and received 50,000 won through the IB bank account (J) in the Defendant’s name, from H, which reported the above advertisement, and received 50,000 won through the IB bank account (J) in the Defendant’s name, and then received a total of 564 children and youth pornographys as indicated in [Attachment No. 1-564] and [Attachment No. 1-564] as indicated in [Attachment List No. 1-564], 56-2318, 174 “L.P4” as indicated in [Attachment List No. 1565] and “L.4] from the Defendant’s dwelling, and received the above obscenity’s total of 1754 obscene goods from the purchaser to the above 30-day 40-day link and the above 40-day.
