1. The defendant shall pay 10,00,000 won to the plaintiff and 15% per annum from May 27, 2006 to the day of complete payment.

The plaintiff applied for the payment order against the defendant to return the down payment amount, etc. under Seoul Central District Court 2006Ka1817 and "the defendant shall pay the plaintiff 10 million won and 20% interest per annum from the day after the original copy of the payment order was served to the day of complete payment" was served on the defendant on May 12, 2006. The fact that the above payment order became final and conclusive on May 27, 2006 due to the defendant's failure to file an objection can be recognized without any dispute between the parties, or in full view of the purport of the argument in the statement in the evidence No. 1, and the plaintiff filed the lawsuit of this case to suspend the extinctive prescription of the above finalized payment order on May 24, 2016. The defendant is obligated to pay damages for delay calculated with 15% interest per annum from May 27, 2006 to the day of full payment upon the plaintiff's request.

Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
