1. It is based on the Daejeon District Court Branch Decision 2000Kadan7099 delivered on November 6, 2002 against the defendant's plaintiff.

1. Basic facts

A. On July 6, 1996, the Plaintiff obtained approval from the Minister of Trade, Industry and Energy for the execution plan for electric power resource development business under the Act on Special Cases Concerning Electric Power Source Development, and completed the construction of electric transmission lines (C business) on January 22, 1996, starting on January 22, 1996 and completing January 30, 1999. (2) The Defendant owned Daehan 5,990 square meters (hereinafter “the instant real estate”), and the said transmission lines installed by the Plaintiff passed through the airspace part of the instant real estate.

The defendant filed a lawsuit against the plaintiff for the removal of the power transmission line of this case by Seosan Branch of Daejeon District Court 200Kadan7099, and the defendant did not immediately file a lawsuit against the plaintiff for the removal of the power transmission line of this case with the court on November 6, 2002, "the plaintiff removed the power transmission line of this case to the defendant, and pay unjust enrichment equivalent to the rent calculated at the rate of 832,000 won per annum from August 1, 2001 to the date of removal of the above power transmission line of this case (hereinafter "the judgment of this case"). The plaintiff filed a favorable lawsuit against the plaintiff (hereinafter "the plaintiff's appeal of this case") which stated that "the plaintiff did not immediately remove the power transmission line of this case to the defendant for the performance of the above order of 00 days until the date of indirect compulsory removal of the power transmission line of this case," and the defendant did not immediately file an appeal against the plaintiff for the removal of the power transmission line of this case to the court of Daejeon Branch 200 days before the plaintiff received the above order of this case.
