A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 2, 2015, the Defendant: (a) received a proposal from the other party to “in order to use the passbook for money exchange at a sports Saturday site; (b) obtained 120,000 won per day from the other party to use the passbook; and (c) received a proposal from the other party to “in order to use the passbook for money exchange, 120,000 won per day.”

1. No person shall borrow or lend, or store, deliver or distribute any access medium for electronic financial transactions while knowing that he/she is to receive, request or promise any consideration, or be used for a crime;

Nevertheless, around January 11, 2016, the Defendant promised to receive the payment of KRW 120,000 won per day from the subscription book for the head of the Tong, which was known through the Gu’s website, at the Defendant’s residence located in Geumcheon-gu, Seoul Special Metropolitan City through the telephone, and promised to receive the price by adding the account number and its password to the Defendant’s corporate bank account (C) and then lent the access medium for the electronic financial transaction after receiving the price to the above subscription book.

2. After the Defendant transferred the access media as described in the foregoing paragraph 1, the name influenite acquired KRW 34,963,00 by means of receiving only money from 222 victims from January 11, 2016 to 20 February 20, 2016 through the Defendant’s account and password, and then obtaining KRW 4,968,00 in return for lending the access media by order of the name influenites.

On the other hand, the defendant transferred the access media to the non-person under the above paragraph 1, and the defendant is a slope belonging to the investigation of the Southern Cancer Police Station around February 4, 2016 and the intelligence team.
