As to the crime No. 1 in the judgment of the defendant, a fine of KRW 8 million shall be imposed on the crime No. 2, 3, and 4 in the judgment.

Punishment of the crime

1. At around 14:00 on March 1, 2019, the Defendant ordered the “D” restaurant operated by the injured party C in Seo-gu Incheon, Seo-gu, Incheon, to pay the normal food value, etc., as if they would normally pay the food value, etc.

However, the defendant was not in cash, and there was no intention or ability to pay the price even if he was provided with food as above due to lack of certain occupation or property.

Nevertheless, the Defendant, as seen above, did not pay the amount of the said amount even though the Defendant had been subjected to the said deception of the victim’s total sum of KRW 56,00,000 from the victim.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

2. On November 1, 2018, the Defendant was sentenced to imprisonment for six months at the Suwon District Court for fraud, etc., and the said judgment became final and conclusive on February 28, 2019.

On February 14, 2019, around 13:19, the Defendant sent the same attitude to pay the normal food value at the F cafeteria located on the second floor of the building E in Bupyeong-si, Bupyeong-si, and ordered the victim G to provide food and drink.

However, there was no intention or ability to pay the food value.

The Defendant, by deceiving the victim as above, obtained food and alcohol equivalent to KRW 38,00,00, in total, from the victim, 2,000, 38,000.

3. On February 14, 2019, at around 09:20 on February 14, 2019, the Defendant: (a) opened the toilet door from which the victim J (the age of 40) reported the breath, and opened two times the victim’s left breast from the toilet door, without any reason, on the part of the victim, who was waiting for the said I restaurant to file a report with the police; (b) taken the part of the victim’s breast by walking the breast, which was waiting for the said I restaurant by requesting the police to walk the victim’s report.

4. The Defendant of the 2019 Highest 1878 on February 13, 2019: (a) around 23:55, the Defendant shall pay the food value to the K Building in Bupyeong-si, the restaurant run by the victim L on the first floor, and the fact that there is no money in water.
