1. On October 25, 2011, Defendant A connected to the Defendant’s residential area located in J apartment 119 dong 802 at the Defendant’s residential area, which was located in the Gyeonggi-si, to the “K” Web site (K) by using a computer, and then, Defendant A opened a video file, “Mixed No. 231 : 704x396 XviD” without permission of the copyright owner, thereby allowing many unspecified web hard members to download it.
In addition, from around that time to September 4, 2013, the Defendant opened a total of 2,081 video files, as shown in the attached Table 1, with the same circumstance, and received approximately KRW 125,682 from the side of the above web harder operator as commission fees.
Accordingly, the defendant had habitually infringed the author's property right by means of reproduction, public transmission, and distribution for profit.
2. On February 1, 2013, Defendant B visited “K” web site (K) by means of a computer at the location of the Defendant’s residence located in Seojin-gu L located in Seojin-gu, Jeonjin-gu, Seoul, Seoul, and opened a video file, “HDTV. HDTV. H264.720p-JOA” in January 1, 2012, without permission of the copyright owner, Defendant B got many unspecified web hard members to download it.
In addition, from around that time to August 9, 2013, the Defendant opened a total of 760 video files as shown in the attached Table 2 with the same background, and received approximately KRW 142,000 from the side of the said web harder operator as commission fees.
Accordingly, the defendant had habitually infringed the author's property right by means of reproduction, public transmission, and distribution for profit.
3. Defendant C, around August 25, 2012, connected to the website (K) via a computer at the location of the Defendant’s residence located in Gangseo-si, Gangwon-si, the Defendant permitted the copyright holder to use a video file “K” (MJR/ Original Copy [BD1920 x 1080], but ridge 01-09, which is a ridge kindergarten01-09.
