1. On May 27, 2015, the Defendant filed a claim seeking revocation of the disposition of rejection for reappointment between the Plaintiff and the Intervenor joining the Defendant.

On May 27, 1991, the Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) was promoted as an assistant professor on April 1, 1996 after being appointed as an electronic calculation at A University and a full-time lecturer.

A School Foundation C, a school foundation that establishes and operates A University, (hereinafter referred to as “C”), commenced procedures for the examination of reappointment of participants around August 1999.

At the time of the examination for reappointment, Article 28 of the Regulations on the Personnel Management of Faculty Members of A University provides that ① Research performance falls short of the standards and ② Work performance evaluation of teaching staff is less than 30 points for exclusion from reappointment.

Among them, the detailed details of the evaluation field, items, grades, scores, evaluators, etc. of teachers' performance and deliberation points are as follows.

C As a result of the review of reappointment of the Intervenor, the Intervenor’s research performance meets the research performance criteria set out in the criteria for review of reappointment, but decided not to re-appoint the Intervenor on the grounds that the total number of teachers’ performance rating points is merely 22 points as follows (hereinafter “decision on refusal of prior reappointment”).
