1. The defendant shall pay 141,00,000 won to the plaintiff and 20% per annum from November 6, 2010 to the day of complete payment.
Reasons
1. Facts of recognition;
A. On June 2007, the Plaintiff completed the construction work by being awarded a contract from the Guro-gu Seoul Metropolitan Government Construction Co., Ltd. (hereinafter “Tinman-5 Construction”) to KRW 286,000,000 (including value-added tax) for the electricity, telecommunication, and fire-fighting work among the new construction works of the 54-5 ground building in Guro-gu Seoul Metropolitan Government.
The Plaintiff filed an application with the court for the payment order of KRW 231,50,000 for the payment order of the said construction from the first instance court 2010 tea2814, and this court on May 17, 2010 ordered the Plaintiff to pay to the Plaintiff the amount of KRW 231,505,000 per annum from the day following the day when the original copy of the instant payment order was served on the Defendant, and the said payment order was served on the first instance court and confirmed on June 11, 2010.
B. On June 1, 2010, 2009, the 1,320,000,000 Won for the 225 ground office-building construction project (hereinafter “instant construction project”) from the Defendant at the time of Made-ro 225, Maok-dong (hereinafter “instant construction project”) and completed the instant construction project at the latest prior to June 1, 2010.
C. On May 19, 2010, this Court rendered a provisional attachment order of KRW 228,505,905 out of the Plaintiff’s claim claim against the Defendant of the instant construction contract amounting to KRW 228,505,90 among the claim against the Defendant of the construction contract amount in the instant case where the Plaintiff’s claim of KRW 228,505,90 against the Defendant of the construction contract amount was issued on May 20, 2010. The provisional attachment order was served on the Defendant on May 20, 2010.
After that, the plaintiff filed an application for the seizure and collection order of the claim to transfer the provisional seizure to the provisional seizure based on the original copy of the above payment order under this court 2010TTTTT No. 12392, and this court transferred the provisional seizure of KRW 228,505,90 among the construction cost claim of this case to the provisional seizure, and seized KRW 11,792,562 among the above construction cost claim of this case, and the creditor is above.
