A defendant shall be punished by imprisonment for three years.

The Defendant and the respondent for an attachment order (hereinafter “Defendant”) were sentenced to imprisonment with prison labor for one year and two years under suspension of execution on June 29, 2012 for the crime of violating the Act on the Protection of Children and Juveniles against Sexual Abuse (Rape, etc.) and the crime of indecent act by force at the original trial of the Busan High Court.

피고인은 피해자가 취기와 졸음을 이기지 못하고 깜빡 잠이 들자 그 틈을 이용하여 피해자의 입술에 입을 맞추었는데, 피해자가 정신을 차리고 피고인을 밀치며 때리는 등 반항하자, 피고인은 피해자의 옷을 강제로 벗기고 피해자의 양손 손목을 꽉 잡았다가 오른손으로 피해자의 양손 손목을 모아 쥐고 왼손가락을 피해자의 음부에 집어넣었다가 빼기를 반복하였다.

피해자가 아픔을 호소하며 그만두라고 사정하고 손으로 피고인의 얼굴을 때리는 등으로 계속 반항하자, 피고인은 격분하여 손으로 피해자의 얼굴을 수회 때리고 “폭행 때문에 벌금 문지 얼마 되지 않았다. 니 죽이고 나 들어가면 된다. 가만히 있어라.”고 윽박질러 피해자의 반항을 억압한 다음, 피해자로 하여금 자신의 성기를 빨도록 한 후 피해자를 1회 간음하였다.
