A is a person who exercises overall control over the safety management, etc. at the construction site as a site manager of the above C Co., Ltd. and acts for Defendant C Co., Ltd.

B It is a person who performs supervisory duties as a responsible construction management engineer (the head of supervision) in the construction site belonging to the Hongcheon District Co., Ltd., which received “F” from the soil management office of Hongcheon District Co., Ltd. on February 27, 2017.

1. Defendant A

A. On December 16, 2017, the Defendant: (a) committed a violation of the Industrial Safety and Health Act and a violation of occupational health law related to the death of workers H; and (b) caused the victim H (50) to work at the cutting slope located in the above construction site located in Jina-gun I on December 16, 2017.

The height of the cutting slope of the above field has reached about 50 meters from the ground, and the installation work of the released area network has been engaged in moving the work to the rapidly rapid cut area while the slope was salking, so there was a risk of a fall accident in the middle of the work.

In such cases, in order to prevent safety accidents, the defendant, who is the head of the site office in charge of safety management of workers in the construction site, has a duty of care to conduct safety education and inspection of safety equipment against all workers at the beginning of the work site, and if it is difficult to install a safety net, etc. around the work site or install a safety string system to wear safety belts, and to take necessary measures to prevent danger, such as taking measures to ensure safety belts and work at the work site.
